These Terms apply to anyone ("you") who uses the Wayvr platform operated by R. Coleman ("Wayvr") to register for an event, sign a waiver or other document, make a payment, or check in to an event.
These Terms govern your use of the Platform only. They do not replace, modify, or form part of any waiver, release, or other agreement between you and an event organizer.
Wayvr provides software services to event organizers. Wayvr does not organize, operate, supervise, inspect, or control any event, and is not a party to any waiver, release, registration, or other agreement between you and an organizer.
The organizer is responsible for the event, the content of any documents you are asked to sign, and how your registration information is used. Requests or questions relating to an event, a waiver, a refund, or your registration should be directed to the organizer.
By using the Platform, you consent to:
Your electronic signature has the same effect as a handwritten signature where permitted by law.
To use the Platform you need a device with a current web browser, an internet connection, and a valid email address if the organizer requires one. If you do not wish to sign electronically, or you would like a paper copy of a document, contact the event organizer before signing. You may withdraw your consent to electronic records for future transactions by contacting the organizer, but documents already signed remain effective.
Wayvr may record audit trail information in connection with electronic signatures, including timestamps, name, email address, IP address, device and browser information, event identifiers, and waiver version, as described in the Wayvr Privacy Policy.
You confirm that:
Your information is processed as described in the Wayvr Privacy Policy. The event organizer is generally responsible for deciding what information is collected and how it is used; Wayvr processes it on the organizer's behalf. Requests relating to your registration or waiver information should generally be directed to the organizer first.
If you make a payment through the Platform, the payment is processed by a third-party payment processor connected by the organizer, under that processor's own terms. Wayvr does not hold your funds and does not store full payment card numbers. Refunds and payment disputes are between you, the organizer, and the payment processor.
You may not use the Platform for unlawful purposes, provide false information or forged signatures, attempt unauthorized access, or interfere with the operation or security of the Platform.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. WAYVR MAKES NO REPRESENTATIONS ABOUT ANY EVENT, ORGANIZER, OR THE CONTENT, VALIDITY, OR ENFORCEABILITY OF ANY DOCUMENT YOU SIGN THROUGH THE PLATFORM.
To the maximum extent permitted by law, Wayvr is not liable for any event or its operation, the conduct of any organizer, the content of any waiver or other document, or any injury, loss, or damage arising from your participation in an event. Wayvr is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
Nothing in these Terms limits rights you may have under applicable consumer protection laws that cannot be limited by agreement.
Ontario, Canada, except where the consumer protection laws of your place of residence require otherwise.
Wayvr may update these Terms from time to time. The version in effect when you use the Platform applies to that use.
